ACEX Mind: Poker Mental Game — Terms of Use (and End User License Agreement)

PLEASE READ THESE TERMS CAREFULLY. By accessing or using ACEX Mind: Poker Mental Game (the "App") and related services (collectively, the "Service"), you agree to these Terms of Use (the "Terms"). If you do not agree, do not use the Service.
1. Who We Are
The Service is provided by ChienHua Lin, operating as ACEX Mind ("ACEX Mind," "we," "us," or "our").

2. Eligibility (18+ Only)
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18+ and capable of entering into a binding agreement.
3. Accounts and Security
You may need an account to use the Service. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4. The Service
ACEX Mind provides poker mental performance training tools, including:
- Session Recording: Track your poker sessions with pre-session and post-session structured data
- Tilt Capture: Record emotional disruption events during sessions with type, severity, and triggers
- AI Diagnosis: Receive structured AI-powered analysis of your mental game patterns through the Deep Review feature
- Training Tasks: Complete AI-recommended training exercises to address identified patterns
- Performance Metrics: Track four core metrics — Focus Quality, Tilt Control, Recovery Speed, and Training Discipline
- Progress Visualization: View trends and charts showing your improvement over time
The Service is for educational and training purposes only. No real-money gambling is offered or facilitated by the Service.
5. Important Disclaimers
A) No Gambling or Financial Advice
We do not provide gambling advice, betting instructions, or guarantees of profit. Any analysis, suggestions, or outputs are informational and educational only. You are solely responsible for your decisions, actions, and outcomes at the poker table.
B) Not Medical or Mental Health Treatment
The Service is not a medical device and does not provide medical, psychiatric, psychological, or therapeutic services. The Service does not diagnose, treat, cure, or prevent any medical or mental health condition.
The tilt tracking, AI diagnosis, and training features are poker performance tools, not clinical assessments. If you need professional help, seek a qualified professional. If you are in crisis or think you may harm yourself or others, contact local emergency services immediately.
C) AI-Generated Content
AI diagnosis responses are generated by artificial intelligence and may not always be accurate, complete, or applicable to your specific situation. AI outputs should be treated as suggestions for self-reflection, not as definitive assessments. You should use your own judgment when applying any AI-generated recommendations.
D) No Guaranteed Results
We do not guarantee any performance improvement, earnings, or outcomes. Progress depends on many factors outside our control.
6. Subscriptions, Billing, and Payments
A) Plans
The Service offers subscription tiers, currently including:
- Free: Limited features and AI diagnosis quota
- Standard (Monthly): Expanded features and higher AI diagnosis quota
- Premium (Monthly): Full features and highest AI diagnosis quota
Exact pricing, benefits, and quotas are shown at purchase and may vary by region.
B) App Store / Google Play Billing
If you purchase a subscription through Apple's App Store or Google Play, payment is charged to your Apple ID / Google Play account. Subscriptions automatically renew until canceled. You can manage and cancel your subscription in your App Store / Google Play account settings before the renewal date to avoid renewal charges.
C) No Direct Refunds for Store Purchases
Refunds for purchases made through Apple or Google are handled by Apple/Google under their respective policies. We cannot directly issue refunds for those purchases.
D) Changes
We may change subscription offerings, pricing, or features from time to time as permitted by applicable store rules and law. Any changes will be disclosed through the purchase flow and/or within the Service.
E) Free Features / Free Allowances
We may offer free features or free usage allowances. Free allowances may change or end at any time.
7. License to Use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on devices you own or control, strictly in accordance with these Terms and any applicable store rules.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Use the Service in a way that promotes or facilitates illegal gambling or violates gambling laws where you reside
- Reverse engineer, decompile, or attempt to derive source code, except where permitted by law
- Circumvent security, access controls, usage limits, or paywalls
- Interfere with or disrupt the Service or attempt unauthorized access
- Submit content that is illegal, harmful, infringing, or violates others' rights
- Attempt to manipulate AI diagnosis outputs or abuse AI usage quotas
9. User Content
A) Your Content
"User Content" includes information you submit to the Service (e.g., session data, tilt event descriptions, Deep Review inputs, notes, and other inputs).
You retain ownership of your User Content as between you and us.
B) Our Limited License to Provide the Service
You grant us a limited license to host, store, process, and use your User Content solely to:
- Provide, operate, maintain, and secure the Service
- Compute derived metrics and generate AI diagnoses for your account
- Troubleshoot, prevent abuse, and enforce these Terms
C) No Global Model Training
We do not use your User Content to train or improve a general AI model for other users.
D) Your Choices
You can request deletion of your account and associated User Content as described in Section 12.
10. Privacy
Our collection and use of personal data is described in our Privacy Policy (https://acexmind.com/privacy). By using the Service, you acknowledge that your data may be processed and stored in countries outside your own, depending on where our service providers operate.
11. Third-Party Services
The Service relies on third-party services (e.g., Google Firebase, OpenAI, Apple/Google for authentication and payments, RevenueCat for subscription management). We are not responsible for third-party services not under our control. Your use of third-party services may be governed by their own terms and policies.
12. Termination and Account Deletion
A) Termination by Us
We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or others.
B) Account Deletion by You
You may delete your account at any time through the app (Settings > Delete Account). Upon deletion, we will delete your User Content associated with your account, subject to limited retention:
- For legal compliance
- To resolve disputes
- For security, fraud prevention, and enforcement
- For short-term backups that are routinely overwritten
13. Intellectual Property
The Service, including its software, design, text, content (excluding your User Content), trademarks, and logos, is owned by ACEX Mind or its licensors and is protected by applicable laws. No rights are granted except as expressly set out in these Terms.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACEX MIND WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN ANY EVENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so these limits may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless ACEX Mind from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.
17. Governing Law and Disputes
These Terms are governed by the laws of Taiwan (R.O.C.), excluding its conflict-of-laws rules.
You agree that, except where prohibited by mandatory consumer protection laws, any dispute will be brought in the courts located in Taiwan, with venue in the Tainan District Court as the court of first instance.
Consumer Rights: Nothing in these Terms limits any rights you may have under mandatory consumer protection laws. If you are a consumer in a jurisdiction that grants you the right to bring claims in your local courts, you may do so.
18. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., in-app notice). Your continued use after the effective date of updated Terms means you accept them.

20. Apple App Store Additional Terms
If you downloaded the App from Apple's App Store:
(a) Acknowledgment: These Terms are between you and ACEX Mind only, not Apple.
(b) Scope: The license is limited to use on Apple-branded products you own/control and as permitted by App Store rules.
(c) Maintenance and Support: ACEX Mind is solely responsible for providing maintenance and support.
(d) Product Claims: ACEX Mind, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal compliance, or consumer protection claims.
(e) Intellectual Property Claims: ACEX Mind, not Apple, will be responsible for any claim that the App infringes a third party's intellectual property rights.
(f) Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
